Wild animals are an important part of nature and play a significant role in maintaining ecological balance. They are the focus of biodiversity conservation and a key part of the construction of ecological civilization. On May 6, 2022, National Forestry and Grassland Administration issued an announcement to solicit public opinions on “Administrative Measures of Special Labels for Wildlife under National Key Protection and Their Products (draft for comments)” and the scope of special labels (the first part).

Articles 27 of the Law of the People’s Republic of China on the Protection of Wildlife clearly stipulate that: Where it is necessary to sell, purchase or use wildlife under national key protection, and the products thereof, for the purpose of scientific research, artificial breeding, public exhibition or performance, protection of cultural relics or for other special circumstances, it shall be upon approval from the departments for protection of wildlife of the people’s governments of provinces, autonomous regions or directly governed municipalities, and a special marker shall be obtained and used in accordance with provisions to ensure tracking, except where the State Council has other provisions for the permitted organ.
Articles 28 of the Law of the People’s Republic of China on the Protection of Wildlife clearly stipulate that: For wildlife under national key protection where artificial breeding technologies are mature and stable, after scientific debate on the merits, the wildlife shall be put on the directory of wildlife under national key protection for artificial breeding, which is to be formulated by the wildlife protection departments under the State Council.For wildlife and the products thereof listed in the directory, an artificial breeding license may be used to directly obtain the special mark in accordance with the annual breeding volume approved by the provincial, autonomous region, or directly governed municipality people’s governments’ departments supervising the protection of wildlife, and the special marker may be used to sell and exploit them, ensuring that they are traceable.
It is reported that China began to carry out a pilot project on the management of special labels for terrestrial wild animals and their products from May 1,2003, which was soon recognized and supported by the industry and the scope of the pilot project has expanded rapidly. The current scope of the pilot project has covered hundreds of wild animal products in the fields of Chinese patent medicine, musical instruments, specimens, etc., and thus it has played a positive role in strengthening wildlife management, law enforcement and supervision. The implementation of the pilot project of special label management has greatly facilitated law enforcement agencies to inspect the legality of the source of wild animals and their products, helped the public to understand the legality of the source of wild animals and their products, and helped the public consciously resist the illegal trade of wild animals and their products. At the same time, this has made the origin of wild animals and their products traceable, helped to enhance the sense of responsibility of practitioners in accordance with to work according to the law, and promoted self-discipline in the industry. From the perspective of streamlining administration and delegating powers, this has simplified the administrative procedures and more effectively maintained the timeliness and autonomy of legal practitioners’ activities.
