The Administrative Reconsideration Law of the People’s Republic of China has been revised twice since it came into force on October 1, 1999. This revision is mainly to implement the decision and deployment on the reform of the administrative reconsideration system, give better play to the institutional advantages of fair and efficient administrative reconsideration, facilitate the people, and play the role of the main channel to resolve administrative disputes, so as to improve the credibility of administrative reconsideration.
The Legal Work Committee of the China Biodiversity Conservation and Green Development Foundation (CBCGDF) attached great importance to the revision work, organized all members to seriously study and discuss, put forward 16 suggestions for the revision of The Administrative Reconsideration Law of the People’s Republic of China (Revised Draft), and submitted them to the Legislative Affairs Commission of the Standing Committee of NPC, hoping to contribute to the revision of the Administrative Reconsideration Law. As a public welfare organization that has been committed to protecting the social ecological environment through legal means for a long time, the Law Working Committee of CBCGDF appeals to all sectors of the society to actively provide advice and suggestions for the construction of the national legal system.
The 16 suggestions for the revision covered Chapter I General Provisions, Chapter II Application for Administrative Reconsideration, Chapter III Acceptance of Administrative Reconsideration, Chapter IV Administrative Reconsideration Trial, Chapter V Administrative Reconsideration Decision and Chapter VI Legal Liability.
